Terms of Service

Introduction

These Terms of Service ("Terms") govern your access to and use of omemo, operated by omemo, Inc. ("omemo", "we", "us"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. Acceptance of Terms

By accessing or using omemo — including the website, iOS app, and related services — you confirm you have read, understood, and agreed to these Terms and our Privacy Policy. These Terms form a binding agreement between you and omemo, Inc.

2. Account & Eligibility

• You must be at least 13 years old to use omemo
• You must provide accurate information when creating an account
• You are responsible for safeguarding your account credentials and any activity under your account
• You may sign in with email/password or with your Google account via Google Identity Services
• Notify us promptly at hi@omemo.app if you suspect unauthorized access

3. Acceptable Use

You agree not to:

• Use omemo for any unlawful, harmful, fraudulent, or abusive activity
• Upload content you do not have the right to share or that infringes others' rights
• Upload content depicting child sexual abuse, non-consensual intimate imagery, or content that incites violence
• Attempt to reverse engineer, decompile, scrape, or otherwise extract source code or model weights
• Interfere with the operation of the service, bypass rate limits, or probe security mechanisms
• Use the service to build a competing product or to train competing AI models
• Resell, sublicense, or share access without our written permission

4. User Content

• You retain ownership of the screenshots, intents, and content you submit to omemo
• You grant omemo a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your content solely to operate, secure, and improve the service for you
• You represent that you have all rights necessary to grant this license
• You can delete your content at any time; deletion is processed as described in our Privacy Policy

5. Third-Party Services

omemo integrates with third-party services to deliver functionality. Your use of these features is also subject to the third parties' terms:

• Apple Sign-In & Google OAuth: Authentication and calendar event creation
• Supabase: Database hosting, authentication, file storage, and serverless functions
• Algolia: Search indexing across your intents
• Logo.dev: Brand logo enrichment

We are not responsible for the availability, accuracy, or content of third-party services.

6. Intellectual Property

The omemo name, logo, software, designs, and all related intellectual property are owned by omemo, Inc. and protected by applicable laws. These Terms do not grant you any right to use our trademarks, branding, or proprietary materials without our prior written consent.

7. Termination

• You may close your account at any time from the app settings
• We may suspend or terminate your account if you violate these Terms or if required by law
• Upon termination, your right to use the service ends immediately
• Account deletion permanently removes associated data within 30 days, as described in our Privacy Policy

8. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. omemo extracts intent from screenshots using AI and does not guarantee the accuracy, completeness, or reliability of extracted information. You are responsible for verifying important details (dates, locations, confirmation numbers, calendar events) before relying on them.

9. Limitation of Liability

To the maximum extent permitted by law, omemo, Inc. and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the service. Our total aggregate liability for any claim arising out of or relating to these Terms or the service shall not exceed the greater of the amounts you paid us in the twelve months preceding the claim or one hundred U.S. dollars (USD 100).

10. Indemnification

You agree to indemnify and hold harmless omemo, Inc. from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the service, your content, or your violation of these Terms or applicable law.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice. Your continued use of the service after the changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the service shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
